Because Pennsylvania does not recognize a legal union between same sex couples, the rights and protections afforded to married couples are not available for same sex partners that cohabitate together. Therefore, it can be very important for same sex partners to specify their rights and obligations in a cohabitation agreement – which is a legal document that specifies what happens in the event of a break up or death. Among other things, a cohabitation agreement can address the sharing of living expenses during the course of the relationship, the division of acquired assets/debts in the event of a death or separation, and financial support following a relationship’s dissolution.
